PRIVACY POLICY

 

This Privacy Policy (hereinafter, the "PRIVACY POLICY") regulates the general conditions that govern the collection and processing by the SPANISH ASSOCIATION OF MANUFACTURERS OF MACHINE TOOLS, THEIR ANCILLARY COMPONENTS AND CUTTING AND DEFORMATION TOOLS AND OTHER MANUFACTURING SYSTEMS AND TECHNOLOGIES (hereinafter, "AFM") of the personal data provided by you as the user of the https://www.afm.es website (hereinafter, the "WEBSITE"), including the services available through the WEBSITE at any given moment. This does not exclude the specific provisions set forth in certain sections, forms or services available on the WEBSITE, available to provide users with relevant information or request their consent, where applicable.

AFM reserves the right to make changes to its PRIVACY POLICY to adapt it to legislative, jurisprudential and/or administrative developments, as well as to the methods used in its WEBSITE at any time to protect its rights and interests.

AFM will provide users with the technical resources to access the PRIVACY POLICY in compliance with its obligation to provide information set forth in applicable data protection regulations.

1. WHO IS THE PERSONAL DATA CONTROLLER?

The Controller of your data is AFM, with registered address at Donostia-San Sebastián, Parque Científico y Tecnológico de Gipuzkoa – Paseo Mikeletegi, nº 59, entered in the National Registry of Associations with number 614562 and TIN (Tax Identification Number) G-20065637.

2. HOW DO WE OBTAIN YOUR DATA?

The data processed by AFM are obtained from you, through: (i) the various forms you complete while browsing through the WEBSITE (e.g., subscription to the Newsletter, contact forms, job application forms and/or recruitment processes, etc.) and/or (ii) by submission of an e-mail requesting information.

If the personal data submitted belong to a third party, you guarantee that you have informed the third party of the PRIVACY POLICY and have obtained their permission to provide their data to AFM for the purposes explained below.

You are also advised that your social network data may be processed through the corporate profiles of AFM in each social network according to the terms and conditions established by each of these networks.

3. WHAT TYPE OF DATA DO WE PROCESS?

AFM processes the data provided by you through the various forms we use to establish contact with you and/or by e-mails, as well as those obtained through AFM corporate profiles in the social networks we use.

Specifically, AFM processes the following data categories:

  • Identification and contact data (e.g., name, surnames, ID, mailing and e-mail addresses, phone numbers, etc.).
  • User identification codes and passwords registered in the WEBSITE.
  • Internet browsing data (e.g., IP address, website visits, WiFi network connections, etc.).
  • Personal data, such as training and employment, etc. (job applications and offers and/or in the event that you participate voluntarily in AFM recruitment processes).

4. FOR WHAT PURPOSE AND UNDER WHAT LAWFUL BASIS DO WE PROCESS YOUR DATA?

Your personal data are processed for the following purposes:

  • To manage and process your registration as a user, when possible.
  • To manage your access and use of the contents and services placed at your disposal by AFM through the WEBSITE, including blogs, social networks or any other functionalities that may be accessed from the WEBSITE at any given time.
  • To process and manage contracts of products or services entered into with AFM through the WEBSITE, manage delivery of said products and, in general terms, to maintain, manage and control the mutual contractual relationship established by purchasing our products or services.
  • To process and manage information requests, suggestions, complaints or claims through the WEBSITE or by e-mail.
  • To process and manage contracting and provision of services entered into with AFM through the WEBSITE.
  • To send commercial and advertising information from AFM and other organisations associated with AFM by various means, including electronic media, regarding products, services, offers, discounts and any other relevant information from these organisations, provided you have granted your consent.
  • To manage your subscription to our “newsletter” service and the delivery of the corresponding electronic notifications, provided you have granted your consent.
  • To manage your job application or inscription in a job offer and participation in the subsequent recruitment process.

In compliance with applicable regulations, AFM will process your personal data based on: (i) your implied consent when you voluntarily submit your personal data through the means provided in the WEBSITE and/or (ii) the relationship established with AFM in the event that you contract our products or services.

It is important to remember that when processing is granted by your consent, you can withdraw your consent at any time according to the terms and conditions described in Section 7 below.

5. WHO DO WE COMMUNICATE YOUR DATA TO?

Your personal data may be communicated to the following third parties:

  • Public Authorities and Agencies that AFM is legally required to submit your data to, should such request be made.
  • When consented by you, to the following organisations associated with AFM: ADDIMAT, AFMEC, ESKUIN, UPTEK and INVEMA. In these cases, your personal information will be communicated to respond to your requests for information or queries and/or to provide you with commercial information from these organisations and their respective activities and products.

International transfer of your data is not contemplated.

6. HOW LONG WILL WE KEEP YOUR DATA?

In general terms, your personal data will be stored until you withdraw your consent to processing or request their elimination, as well as long as necessary for AFM to comply with its legal obligations.

AFM has internal policies in place to eliminate personal data in its possession when they are no longer necessary and/or adequate for the purpose they were collected for.

Your personal data submitted for management of job applications will be kept for a maximum period of 2 years.

7. WHAT ARE YOUR RIGHTS?

Applicable data protection regulations grant you a series of rights that may be exercised by you during processing of the same. These rights are described below:

  • Right of access: you have the right to access your data and know which of your data are being processed by us.
  • Right to rectification or erasure: in certain circumstances, you have the right to rectify any incorrect data that are being processed by us or to request that they be eliminated if, among other reasons, these data are no longer necessary for the purpose they were collected for.
  • Right to restrict processing: in certain circumstances, you have the right to request that processing of your data be restricted, in which case your data will only be kept to present or defend ourselves from claims, as set forth in applicable data protection regulations.
  • Right to data portability: in certain circumstances, you have the right to receive any personal data provided to us in a format that is structured, commonly used and mechanically legible, and to transmit them to another data controller.
  • Right to object: in certain circumstances and for reasons related to your particular situation, you have the right to object to processing of your data, in which case they we shall cease to process them unless we are required to keep them by law or to present or defend ourselves from eventual claims.

You also have the right to withdraw your consent at any time, although this will not affect the legal processing of your data prior to your request for withdrawal.

You may exercise these rights by a written request to AFM at the mailing address indicated in Section 1 or by sending an e-mail to rgpd@afm.es.

You can also present a complaint to the competent Control Authority (the Spanish Data Protection Agency) if you are not satisfied with the results of exercising your rights. You can contact this body at the following website: www.aepd.es.

8. USER COMMITMENT REGARDING DATA PROTECTION

You guarantee that you are of legal age and the that the information submitted is accurate and true. You agree to inform AFM of any change to the information provided by sending an e-mail to rgpd@afm.es, identifying yourself as a user of the WEBSITE and indicating the information that has to be changed.

You also agree to keep in secret the identification codes and passwords that are provided to you and to notify AFM as soon as possible if these are lost, stolen or used for unauthorised access. If AFM is not informed of said events, it shall not be held liable for the consequences derived from use by unauthorised third parties of these identification codes and passwords.

9. SECURITY MEASURES

AFM will maintain your data absolutely confidential keep mandatory secrecy regarding them at all times, as set forth in applicable data protection regulations. We will apply the necessary technical and organisational measures for this purpose to guarantee the security of your data and prevent their loss, unauthorised alteration, processing or access, given the current state of technology, the nature of the stored data and the risks they are subject to.
